Privacy and personal data processing policy

This Privacy and Personal Data Processing Policy (hereinafter referred to as the
“Policy”) governs the procedure for processing and using personal and other data
of the Prime Source LLP website and applications (hereinafter referred to as the
“Operator”). The current version of this Policy is permanently available for
review and is posted in the respective Applications and on the Internet at:
https://www.p-s.kz.
By transferring personal and other data to the Operator via the Website or
Applications, and by completing and submitting Registration Forms, the User
confirms their consent to the use of such data under the terms set out in this
Policy.
If the User does not agree with the terms of this Policy, they must discontinue
using the Website and Applications.
Absolute acceptance of this Policy, and Consent to the collection, processing, and
storage of Personal Data, shall be deemed the User’s Registration and commencement
of use of the Website and Applications.
1. TERMS AND DEFINITIONS
1.1. Website refers to the website located on the Internet at https://www.p-s.kz.
1.2. Application refers to software designed to operate on smartphones, tablets,
and other mobile devices, and developed for iOS, Android, and Windows Phone
platforms.
1.3. User refers to an individual who uses the Website or the Application, having
downloaded it from online stores such as the App Store, Google Play, etc.
1.4. Legislation refers to the applicable laws of the Republic of Kazakhstan.
1.5. Personal Data refers to information relating to an identifiable User,
recorded on electronic, paper, and/or other material media, and provided by the
User independently during registration or in the course of using the Website or
Application functionality.
1.6. Data refers to other information about the User (not included in the
definition of Personal Data).
1.7. Registration refers to the User’s completion of the Registration Form posted
on the Website or in the Application by entering the required information and
submitting scanned documents. 1.8. Registration Form refers to the form posted on
the Website or in the Application that the User must complete in order to fully
use the Website.
1.9. Service(s) refers to services provided by the Operator on the basis of an
agreement.
All exclusive rights to the Website and the Application, and to their individual
components (including software and design), belong fully to the Operator. The
transfer of exclusive rights to the User is not the subject of this Policy.
2. COLLECTION AND PROCESSING OF PERSONAL DATA
2.1. The Operator only collects and stores the Personal Data that are provided by
the User in the Registration Form and are necessary for the Operator to provide
the Services and to interact with the User.
2.2. Personal Data may be used for the following purposes:
2.2.1. provision of Services to the User;
2.2.2. identification (registration) of the User;
2.2.3. interaction with the User;
2.2.4. sending notifications, information, and requests to the User;
2.2.5. conducting statistical and other research;
2.3. The Operator, among other things, processes the following data:
2.3.1. last name, first name, and patronymic;
2.3.2. email address;
2.3.3. telephone number (including mobile);
2.3.4. place of employment and job title;
2.3.5. other information classified as confidential and/or Personal Data.
2.4. The User is prohibited from providing Personal Data of third parties on the
Website (except where the User represents such third parties and holds documented
proof authorizing such actions, and a written Consent from such third parties for
the collection, processing, and storage of their personal data).
3. PERSONAL AND OTHER DATA PROCESSING PROCEDURE
3.1. The Operator undertakes to use Personal Data in accordance with the Law of
the Republic of Kazakhstan “On Personal Data” and the Operator’s internal
documents.
3.2. Personal Data and other User Data remain confidential, except in cases where
such data are publicly available.
3.3. The Operator may retain an archival copy of Personal Data.
3.4. The Operator may transfer Personal Data and User Data without the User’s
consent, to the following parties:
3.4.1. state authorities, including investigative and inquiry bodies, and local
executive bodies upon their substantiated request and in accordance with the
procedures provided for by Legislation;
3.4.2. in other cases expressly provided for by applicable Legislation or
international conventions.
3.5. The Operator may transfer Personal and other Data to third parties not
specified in clause 3.4 of this Policy in the following cases:
3.5.1. the User has given their consent to such actions;
3.5.2. the transfer is necessary for the User’s use of the Website or the
Application and for the provision of Services to the User;
3.6. The Operator performs automated processing of Personal and other Data.
3.7. Consent to the collection, processing, and storage of Personal Data remains
valid for the entire period of the User’s registration on the Website and/or in
the Application.
4. PROTECTION OF PERSONAL DATA
4.1. The Operator ensures appropriate protection of Personal Data and other data
in accordance with the Legislation and takes all necessary and sufficient
organizational and technical measures to safeguard Personal Data.
4.2. The protection measures applied, among other things, ensure the safeguarding
of Personal Data against unlawful or accidental access, destruction, alteration,
blocking, copying, dissemination, as well as any other unlawful actions by third
parties.
5. MISCELLANEOS
5.1. The laws of the Republic of Kazakhstan shall apply to this Policy and to the
relations between the User and the Operator arising in connection with the
application of this Policy.
5.2. Any disputes arising out of this Policy shall be resolved in accordance with
applicable legislation at the place of registration of the Operator.
Before filing a claim in court, the User must comply with the mandatory pre-trial
procedure and submit a corresponding written claim to the Operator. The response
period for such a claim is 15 (fifteen) calendar days.
5.3. If, for any reason, one or more provisions of this Policy are found to be
invalid or unenforceable, such invalidity shall not affect the validity or
enforceability of the remaining provisions of the Policy.
5.4. The Operator has the right to amend this Policy (in whole or in part) at any
time unilaterally, without prior approval from the User. All amendments shall take
effect from the moment they are posted on the Website and in the Application.
5.5. If the User refuses to accept the terms of this Policy or any amendments
thereto, the Website and Applications will be available in a restricted mode.
5.6. The Operator undertakes to notify the User of any amendments to the Policy by
issuing a notice and/or by posting the updated version on the Website and in the
Application.
